She had to appeal to the judges of the Naples court to obtain what she considers her right, that of " not being condemned to suffer ." This is the story of Coletta , the fictitious name chosen by a 44-year-old woman from Campania suffering from amyotrophic lateral sclerosis , who, after being denied medically assisted suicide by her health authority, turned to the judges.

Her story was made public by the Luca Coscioni Association , which is assisting her in her legal battle, the "third request in the region", the association underlines.

Coletta describes herself as "a conscious, clear-headed, and determined citizen," unable to accept that her will "is being crushed by considerations that seem to ignore not only my state of health, but also my right not to be condemned to suffering that no longer makes any sense to me. If I cannot access a legally guaranteed option in Italy, I am considering the only viable alternative: expatriation to die with dignity in Switzerland ."

His lawyer, Filomena Gallo , national secretary of the Coscioni Association, defines as "disconcerting and inhumane" the fact that the relevant local health authority denied assisted death to Coletta, " in full contrast with the rulings of the Constitutional Court ".

Specifically, last June, Coletta challenged the ASL's denial, requesting an urgent reassessment of her condition and the submission of the ethics committee's opinion. The health authority, the Coscioni Association explains, failed to comply with the requests, prompting the 44-year-old to file an urgent appeal with the Naples court.

Marco Cappato , treasurer of the Coscioni Association, instead brings up the Campania Region: "In Campania, our regional bill, tabled over a year ago, has never been discussed in the chamber. Last March, President Vincenzo De Luca himself blocked the bill, declaring the need for a round of consultations, starting with the Episcopal Conference. No consultations were actually organized, and the obstructionist move by President De Luca and his majority has had the effect of denying a clear timeline and method for a response."
